Go Legit as a Property Developer: Your Key to Building Trust and Success in the Real Estate Market
In the fast-paced world of real estate, the demand for housing in the Philippines is at an all-time high. With over 6.7 million units sold as of December 2021, Filipinos are actively searching for reliable and affordable homes. This surge in demand has attracted a flood of dealers, all claiming innovation and integrity. However, not all are as trustworthy as they seem. As the market grows, so does the number of fake brokers and dealers looking to exploit unsuspecting homebuyers.
In this competitive and often deceptive environment, how can legitimate property developers and real estate agents stand out? How can you ensure homebuyers choose you over unlicensed and unscrupulous competitors?
The answer is simple: go legit. Compliance with government laws and regulations not only safeguards your business but also establishes a solid foundation of trust with your clients. Let’s explore how you can differentiate yourself from the bogus brokers by adhering to the legal requirements necessary to operate in the real estate industry.
Why Going Legit Matters
In a booming real estate market, building trust is everything. Homebuyers need assurance that the properties they are purchasing come from reputable developers who adhere to the highest ethical and legal standards. When you comply with the law, you signal to your potential clients that:
• Your business is legitimate.
• You care about their safety and investment.
• You are committed to delivering quality properties.
Compliance with real estate laws is more than just a legal obligation—it’s a competitive advantage that positions you as a trustworthy and credible developer in the eyes of the market.
The Essential Step: Obtaining a License to Sell
One of the most crucial steps in establishing legitimacy as a property developer is obtaining a License to Sell (LTS). This requirement, outlined in Section 5 of Presidential Decree No. 957, serves as a government-issued authorization for property owners or sellers to market and sell properties like condominiums and subdivision lots.
The Department of Human Settlements and Urban Development (DHSUD) is responsible for issuing the LTS, ensuring that developers have the financial stability and compliance needed to engage in legitimate real estate transactions. Without this license, selling properties becomes not only illegal but also highly risky for your business and your clients.
To secure your License to Sell, you must meet the following requirements based on the Revised Implementing Rules and Regulations (IRR) for PD 957:
1. Sworn Registration Statement (HLURB Form 001 for Corporations, HLURB Form 003 for Single Proprietorships)
2. Certified True Copy (CTC) of Original/Transfer Certificate of Title, stamped and sealed by the Register of Deeds
• (Note: Projects with more than 20 titles may require additional documentation)
3. Duly Audited Balance Sheet (CTC or original)
4. Articles of Incorporation, by-laws, or authorization from the Securities and Exchange Commission (SEC)
5. Copies of brochures and marketing materials for public offering
6. A sample copy of the Contract to Sell
7. Environmental Compliance Certificate (ECC) or Certificate of Non-Coverage (CNC), issued by the Department of Environmental and Natural Resources (DENR)
8. Zoning Certificate from the HLURB Regional Office
9. CTC of the DAR Conversion Order
10. Electrical Plan and Specifications
11. Permit to Operate a Deep Well or submission of a water resistivity test from the National Water Resources Board (NWRB), along with water potability test results from government agencies like Maynilad.
The Benefits of Going Legit
1. Increased Credibility: Clients are more likely to trust developers who follow the law and provide proof of compliance. A License to Sell reassures buyers that your business is stable and that their investment is secure.
2. Protection from Legal Issues: Selling properties without the necessary licenses opens you up to potential legal consequences, including fines, penalties, or even the cancellation of your project. Compliance protects your business from these risks.
3. Higher Marketability: Legitimate developers can confidently market their properties, as they have met the requirements set by the DHSUD. Being able to show your License to Sell gives you an edge over competitors operating in the shadows.
4. Building Long-Term Relationships: By establishing a reputation for honesty and transparency, you’re more likely to attract repeat buyers and referrals. Trust is a cornerstone of long-term business success.
5. Better Partnerships: Whether you’re looking to partner with financial institutions, government agencies, or other developers, legitimacy is key. A License to Sell opens doors to better business relationships and growth opportunities.
How Going Legit Can Help You Thrive in the Property Development Industry
In an industry rife with unlicensed dealers and fraudulent brokers, setting yourself apart as a legitimate developer is your greatest asset. By complying with the law and obtaining the necessary permits and licenses, you can build a strong reputation as a trusted name in real estate. This not only attracts buyers but also fosters a culture of professionalism and ethics that can propel your business to new heights.
As the real estate market continues to evolve, homebuyers will increasingly look for developers they can trust. By going legit, you’ll not only protect your business but also establish a foundation of credibility, reliability, and long-term success in the property development industry.
